Family sues MTN, Traditional ruler, Bassa LG over alleged illegal building of Mast on ancestral farmland.

The Muru Ki Mallam Goh Family in Miango District in Bassa Local Government Area of Plateau State North Central Nigeria has sued Communications giant, MTN for alleged illegal building of its network Mast on their ancestral land. Others joined in the suit are Chief Daniel Chega, (District Head of Miango), Miango Traditional Council and Bassa Local Government as 2nd, 3rd and 4th defenders respectively.

In a suit No. PLD/J586/2013, the Plaintiffs, Rubwu Mary Kuito (Nee Waki), Jummai J. Andrew (New Waki), Sunday Yah Turu, Joseph R. Turu and Turu Kpasha for themselves and on behalf of the Muru Ki MallamTuru Goh family claimed against the defendants jointly and severally as follows; 
“A declaration that the piece of land measuring 3.29 hectares situating and lying at Miango District in Bassa LGA, Plateau State and more particularly described in the site plan belongs to the Plaintiffs.

An Order of forfeiture of the customary tenancy granted the 3rd defendant by the Plaintiffs' forebears over the 0.18 hectares as identified and shown out of the 3.29 hectares of the land aforesaid.
An Order directing the 1st defendant to remove the Network Mast illegally built on the farmland of the Plaintiffs”. 
The Plaintiffs also claimed a total sum of 20 Million Naira as general damages for alleged trespass, rancor, acrimony and embarrassment suffered due to actions of the defendants. The claim goes in this manner; ten million naira against the 1st defendant, 5 million naira against the 2nd and 3rd defendants and 5 million naira against the 4th defendant respectively.
The Plaintiffs further prayed the court for an Order of perpetual injunction restraining the defendants, their privies and representatives from interfering from or in any manner trespassing on their 3.29 hectares of land described in the site plan.

When the case came up this morning, the court was told that the defendant's Counsel Joseph Danboyi Esq.was unable to come to court because of ill health.
However, counsel for the Plaintiffs, D. I Umekwe while speaking to African Drum after court session, expressed displeasure over incessant adjournments of the matter at the instance of the defendant's Counsel.
The matter was adjourned until June 17, 2020.
