VS COMMISSION OF INQUIRY: CASE ADJOURNED TO 21ST JUNE

The case between
Senator Jonah David Jang and Governor of Plateau State and nine others has been
adjourned to 21st June, 2017 for hearing. The case is before Justice
Pius Damulak of High Court 1, and was billed to be heard yesterday. However,
the court didn’t sit in the morning but rescheduled for 11:30am. After waiting
till 1 p.m,, Justice Damulak said the court would not sit hence the adjournment.
Jang had dragged the
Plateau State Governor and nine others before Justice Damulak in respect of the
Judicial Commission of inquiry into the activities of government of Plateau
State from 29th May, 2007 to 29th May, 2015.
In the originating
summons taken by Plaintiff’s Counsel, Chief F.G. Odey Principal Partner,
Sunny-Gabriel Odey & Associates of Renaissance Chambers, No. 2, Wase Close
Jos, the plaintiff sought the determination of series of questions backup with
necessary constitutional provisions with regard to the establishment and the
constitution of members of the commission, its proceedings as to whether the
whole exercise was not a nullity, unconstitutional and void.
The Plaintiff also
seeking series of reliefs and an order of perpetual
injunction restraining the 1st 9 defendants from issuing and/or
publishing and recommendation or report pursuant to memorandum No.JCI/64/2016
by Njin Gyars (Exhibit 3) or pursuant to any other Memorandum, petition or any
other process bordering on or containing criminal allegations, imputations or
inferences against the Plaintiff or anybody at all, ……. Order of perpetual
injunction restraining the 1st 3 defendants whether by themselves,
servants, agents, or privies howsoever called from using any evidence taken by
the 4th – 9th Defendants during its proceedings, any
recommendations made thereto or any report issued in respect thereof against
the plaintiff or use same to indict the Plaintiff or indeed any other person in
any civil or criminal proceedings whatsoever aid such orders or further orders
the honourable court may deem.
