Criminal enticement: Court says Prophetess Deborah Fwenji must be served.

Hon. Andrawas Makai of Magistrate Court Bukuru has adjourned until 22 July, 2019 to enable a subpoena served on Prophetess Deborah, wife of Evangelist Danjuma Goshen Fwenji of God’s Grace Divine Mission (GGDM).
Fwenji is standing trial for criminal enticement. A former Federal Law maker, Hon Leonard Dilkon had dragged Fwenji before the Court for alleged enticement of his former wife, Joy. 

When the case file was called on Monday, counsel to the complainant, Francis Okafor Esq told the court that the matter was slated for continuation of hearing. “The matter is slated for continuation of hearing. It was slated for today and tomorrow. We have applied and a subpoena issued on the next witness and same was served on the defense counsel. This morning, the counsel said the same witness cannot be reached. That is the only set-back to today’s hearing, otherwise we would have taken her today and by tomorrow we would have close our case” Said counsel.

Responding, counsel to the defendant, Titilayo Otitiju confirmed being served with the subpoena to produce Mrs. Fwenji in court to testify in the matter. She however said that she called counsel for the complainant in the morning and informed him that it will not be possible in view of the ruling of the same court of 19, February, 2019.
“in the Light of this, I would return the same subpoena today”, said counsel.
However, counsel to the complainant in his response observed that if there was any objection by a party on any issue it must come by way of motion arguing that it was not in the place of any party to interpret the ruling of the court. Counsel said that the proper thing was for witness to be served first and then challenge it.
He appealed to the court to probate on the counsel to serve the witness.

The court asked counsel to the complainant why he wouldn’t want to call other witnesses before prophetess Fwenji. He told the court that taking prophetess Fwenji as the first witness was paramount to the case because she would lay the foundation to be followed by her former husband before the complainant who would eventually prove to the court that indeed, the defendant entices women.
Submission of counsel to complainant was taken and the matter adjourned to 22nd and 23rd of July, 2019.
