PLATEAU PDP: SANGO MAY BE CHARGED FOR CONTEMPT

The Plateau State Chairman of the Peoples Democratic Party (PDP), Hon. Damishi T. Sango may be charged for contempt of Court as he has been served with Form 48 which is a notice of consequences of disobedience to Order of Court.
Recall that Hon. Tapwa Kubut Goma for himself and as representing the executive committee of PDP Kanke LGA had sued Sango and the PDP for refusing to swear them into office as the authentic EXCO for Kanke, instead, Sango is alleged to have appointed an acting Chairman for the LGA.

It is further alleged that while the case with Suit No.: PLD/P45CV/2016 was still ongoing, Sango kick-started the process to conduct fresh elections in Kanke. It is said that when Hon. Goma got wind of that development, he approached the same Court and got an Order of Interim Injunction restraining the Defendants either by themselves, their servants, privies and or any other person howsoever described from conducting a fresh congress election either at the Ward level or Local Government level in Kanke LGA which is the subject matter on the main Suit on 27th September, 2017 or any other day whatsoever pending the determination of Motion on Notice.



However, it is further alleged that despite being served with the Court Order, Sango and the PDP in the State went ahead to conduct the congress elections in Kanke LGA. This is said to have prompted Barrister Lawrence Anyia, Counsel to the Plaintiffs to call the attention of the Court on 5th October, 2017 before moving the Motion when he said, “The Motion on Notice is ripe for hearing and we are ready to move same. However, I want to draw this Court’s attention to the fact that in spite of the filing of interlocutory application to restrain the Defendants from conducting an election in Kanke LGA in this case, as well as sister Case No.: PLD/P45CV/2016, the Defendants have gone ahead to organize an election and swore in a new EXCO and not the Plaintiffs and which is the basis of the two cases and the application to restrain”.
But the Defendants through their Counsel, N.I. Darong vehemently denied the allegation stating that “No elections have been conducted by the Defendants and no new EXCO as a result, have been sworn-in as alleged”.


The instruction in the Form 48 is very clear as it reads; “TAKE NOTICE that unless you obey the directions contained in the Order of Court herein, you will be guilty of contempt of Court and will be liable to be committed to prison”.
