Plateau Bye-Election: Tribunal promises accelerated hearing as it holds inaugural sitting, Pre-Trial Conference

The National and State Houses of Assembly Election Petition Trial Tribunal sitting at the State High Court, Bukuru held its inaugural sitting as well as Pre-Hearing Conference on Tuesday.

Chairman of the three-man Panel, Hon. Justice Hope Ozoh promised accelerated hearing of the petitions and therefore, warned against frivolous applications for unnecessary adjournment. In the light of this, he appealed for the cooperation of Counsel involved in the matter to ensure speedy dispensation of all petitions before the Panel within time.
Justice Ozoh further charged journalists on accurate reportage stressing that they must ensured they report exactly what took place during proceedings at the tribunal.

In their separate goodwill messages, Yakubu Ruba (SAN), the Plateau State Attorney-General and Commissioner of Justice, Hon. Chrysantus Ahmadu who was represented by the Solicitor-General and Permanent Secretary, in the Ministry, Mrs. Rebeccah Shaseet, the Chairman Nigeria Bar Association (NBA) Yakubu Bawa (who spoke on behalf of the four Bars in Plateau State) and Chief Gabriel Odey all promised the cooperation of the state government and counsel involved in the petitions respectively to ensure the success of the tribunal.

The inaugural sitting was preceded by Pre-trial conference which saw among other things, the adoption of Pre-Hearing answer sheets to the Pre-Hearing  Questions earlier filed on various dates by Counsel representing parties in the petitions.

African Drum reports that the setting up of Tribunal by the Court of Appeal was neccesited  by the conduct of Bye-Election for Jos North Bassa Federal Constituency and Pankshin South, State Constituency conducted by INEC on February 26, 2022 following the deaths of Hon. Haruna Maitala and Hon. Henry Longs who represented the two Constituencies respectively.  


At the end of the Bye-Election, INEC declared Hon. Musa Agah of the PDP as winner Jos North/Bassa Federal Constituency and Hon. Ezra Dakup of the APC as winner Pankshin South State Constituency.


Not satisfied with INEC declarations, Hon. Adamu Muhammad Alkali of PRP and Hon. Peter Dasat filed  their various petitions at the tribunal challenging the declaration of Agah and Dakup.

Consequently, parties in the first petition are;  Adamu Muhammad Alkali, PRP- Petitioners while PDP, Musa Agah and INEC as Respondents.The second petition has Peter Dasat, PDP as Petitioners while Ezra Dakup, APC and INEC as Respondents.

In the first petition, Yakubu Ruba (SAN) is Counsel for the Petitioners while Chief Gabriel Odey is Counsel for the 1st and 2nd Respondent and Y.A Gutep for the 3rd Respondent.

In the second petition, Chief Gabriel Odey is for the Petitioners while Musa Attah Ahmed for the 1st Respondent, M. A Dawan and Paschal Mamoh for the 2nd & 3rd Respondent respectively.

Counsel were given three days each to file their applications, another three days for replies and two days for replies on point of law.

The Tribunal adjourned until May 12, 2022 for the delivery of Pre-hearing report and a date for hearing of the petitions.
