ALLEGED ASSAULT: COURT TO SERVE DAN IN HOSPITAL

The alleged assault case between Miss Faith Mapak (Complainant) Vs Hon. Daniel Dul the management Committee Chairman, Lantang North Local government(Defendant) came up for hearing today at the Magistrate Court, UTC Jos.


Daniel Dul will be served in hospital 

 When the case was mentioned, counsel to the defendant, Barr. BM Gamtur informed the court that the accused was not personally served though he is aware of the matter because according to him, “it has gone viral” adding that it was for the above reason that the accused briefed him and instructed him to represent him in court, adding that the accused could not appear in Court personally because he is hospitalized.

Responding, counsel to the Complainant Barr. Jumoke F. Oguntayo said that the accused had evaded service on two occasions; consequently, she applied for substituted service to be pasted on the accused residences both in Jos and Langtang so as to compel him to come to court. However, the defence counsel said that if his client has been evading service, he wouldn’t have asked him to represent him in court, insisting that the accused was still lying down in a hospital bed in Jos.

The defence counsel further suggested to the court to allow him to lead the court bailiff to serve the accused in the hospital as an option for substituted service.

In his ruling, Magistrate Nanglong Dashe observed that what is needed to be done at the moment was to ensure service on the accused, and since the defence counsel has undertaking to lead the court bailiff for that purpose, he considered that option. He however, cautioned the defence counsel to keep to his promise, being a minister in the temple of Justice. The case was adjourned to May 9, 2017 for hearing.

Recall that Miss Mapak recently lodged a direct criminal complaint in the Magistrate court against Hon. Dan Dul for alleged assault on her.
